Aparu Essence operates this shop and website, including all related information, content, features, tools, products and services, to provide you, as a customer, with a personalised shopping experience (the “Services”). Aparu Essence is powered by Shopify, which enables us to provide the Services. This privacy policy describes how we collect, use or disclose personal data when you visit or use the website, make a purchase or other transaction using the Services, or otherwise communicate with us. If there is a conflict between our general terms and conditions and this privacy policy, this privacy policy takes precedence regarding the collection, processing and disclosure of your personal data.
This privacy policy informs you about the processing of personal data. Merely using our website does not constitute consent. Where consent is required, we obtain it separately; you may withdraw it at any time with effect for the future.
Controller and legal bases for our shop
The controller is Adnan Alagic, trading as Aparu Essence, Bechstedter Weg 3, 10713 Berlin, Germany. Email: info@aparu-essence.com, telephone +49 152 58504500.
Orders, payment, delivery, customer account and contract-related enquiries: We process necessary contact, order and transaction data to perform the contract and take pre-contractual steps under Article 6(1)(b) GDPR.
Legal obligations: We process necessary business and supporting-document data to comply with statutory retention and documentation obligations under Article 6(1)(c) GDPR.
Other enquiries and protection of the shop: Article 6(1)(f) GDPR, where no more specific legal basis applies. Our legitimate interests are handling your enquiries, the security and functioning of the shop, preventing misuse and safeguarding legal claims. Necessity and opposing interests are taken into account.
Newsletter and publication of voluntary reviews: Article 6(1)(a) GDPR, based on your respective consent. Consent to publication is voluntary. Email addresses and order numbers are not published with a review. You may unsubscribe from newsletters using the unsubscribe link or our contact address; you may withdraw consent to publication through our contact address.
Cookies, analytics and personalised advertising requiring consent: Article 6(1)(a) GDPR and, for storing or accessing information on your device, § 25(1) TDDDG. § 25(2) TDDDG applies to strictly necessary storage or access operations. You can change your choices through “Cookie settings” in the footer.
General descriptions of marketing and analytics functions in this policy do not replace any required consent. Where the GDPR applies, you have, subject to the statutory conditions, rights of access, rectification, erasure, restriction of processing, data portability and complaint to a data protection supervisory authority. For processing under Article 6(1)(f) GDPR, you may object on grounds relating to your particular situation; you may object to direct marketing at any time. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
Required information is marked as mandatory in the respective forms. Without the necessary order and delivery information, we cannot process an order. Newsletter consent is not a condition of making a purchase.
What personal data do we collect or process?
When we use the term “personal data”, we mean information that identifies you or another person or can be directly linked to you. Personal data does not include information collected anonymously or anonymised so that identification or association with you is not possible. Depending on how you interact with the Services, where you live and what applicable law permits or requires, we may collect or process the following categories of personal data, including inferences drawn from that personal data:
- Contact details, including name, postal address, billing address, delivery address, telephone number and email address.
- Financial data, including credit card, debit card and financial account numbers, payment card information, financial account information, transaction details, payment method, payment confirmation and other payment details.
- Account information, including username, password, security questions, configurations and settings.
- Transaction information, including items you view, add to your cart or wish list, purchase, return, exchange or cancel, and your past transactions.
- Communications with us, including information you provide when communicating with us, for example when submitting a customer support enquiry.
- Device information, including information about your device, browser or network connection, IP address and other unique identifiers.
- Usage information, including information about your interaction with the Services, including how and when you interact with or browse them.
Sources of personal data
We may collect personal data from the following sources:
- Directly from you. We collect data, among other things, when you create an account, access or use the Services, communicate with us or otherwise provide us with your personal data.
- Automatically through the Services. We collect data, among other things, from your device or when you use our products or Services or visit our website, and through cookies and similar technologies.
- From our service providers. We collect data, among other things, when we engage service providers to enable certain technologies and when they collect or process your personal data on our behalf.
- From our partners and other third parties.
How do we use your personal data?
Depending on how you interact with us or which Services you use, we may use personal data for the following purposes:
- Providing, customising and improving the Services. We use your personal data to provide the Services. This includes, among other things, performing our contract with you, processing your payments, fulfilling your orders, saving your configurations and items of interest, sending notifications relating to your account, creating, maintaining and otherwise managing your account, arranging shipping, facilitating returns and exchanges, enabling you to submit reviews, and providing a personalised shopping experience, for example by recommending products based on your purchases. This may also include using your personal data to better customise and improve the Services.
- Marketing and advertising. We use your personal data for marketing and advertising purposes, for example to send marketing and advertising communications by email, SMS or post, and to show you online advertising for products or services on the Services or other websites, including based on items you previously purchased or added to your cart and other activities relating to the Services.
- Security and fraud prevention. We use your personal data to authenticate your account, provide a secure payment and shopping experience, detect, investigate or take action concerning potentially fraudulent, illegal, unsafe or malicious activities, protect public safety and keep our Services secure. If you choose to use the Services and register an account, you are responsible for protecting your account login details. We strongly recommend that you do not share your username, password or other access details with anyone else.
- Communicating with you. We use your personal data to provide customer support and effective Services, respond promptly to your enquiries and maintain our business relationship with you.
- Legal reasons. We use your personal data to comply with applicable law or respond to lawful legal process, including requests from law enforcement or regulatory authorities, investigate or participate in civil investigations, potential or actual litigation or other adversarial proceedings, and investigate potential violations of or enforce our terms or policies.
How do we disclose personal data?
In certain circumstances, we may disclose your personal data to third parties for legitimate purposes in accordance with this privacy policy. Such circumstances may include:
- With Shopify, vendors and other third parties that provide services on our behalf, such as IT management, payment processing, data analysis, customer support, cloud storage, fulfilment and shipping.
- We disclose personal data to business and marketing partners that provide marketing services for you and display advertising to you. For example, we use Shopify to support personalised advertising through third-party services based on your online activities across different merchants and websites. Our business and marketing partners use your data according to their own privacy policies. Depending on where you live, you may have the right to direct us not to disclose information about you for targeted advertising and marketing based on your online activities across different merchants and websites.
- When you instruct us or otherwise consent to our disclosing certain information to third parties, for example to deliver products to you, or when you use social media widgets or login integrations.
- We disclose personal data to our affiliates or otherwise within our corporate group.
- In connection with a business transaction such as a merger or insolvency, to comply with applicable legal obligations, including responding to subpoenas, search warrants and similar requests, enforce applicable terms of service or policies, and protect or defend the Services, our rights and the rights of our users or others.
Communication and security services used in the shop
Newsletter and Klaviyo
We use Shopify and Klaviyo to manage newsletter subscriptions and email marketing. The Shopify integration transmits customer and order information and email subscription status to Klaviyo. This may include contact details, consent information, ordered items and order events. Behavioural data from website tracking requiring consent is processed only with your corresponding consent. An order alone is not consent to a newsletter.
Separate registration with confirmation by email is envisaged for the newsletter. You may withdraw your consent at any time through the unsubscribe link in a marketing email or through info@aparu-essence.com. Order and service messages without advertising content remain unaffected. The legal basis for the newsletter and personalisation based on it is Article 6(1)(a) GDPR. Information about Klaviyo’s processing, international transfers and subprocessors is provided in Klaviyo’s privacy notice and its subprocessor list.
Contact form and email
When you send an enquiry, we process the information you enter and the message content to handle your request. The shop contact form is provided through Shopify; our email mailbox is operated by IONOS. Processing takes place under Article 6(1)(b) GDPR for contract-related requests and otherwise under Article 6(1)(f) GDPR on the basis of our interest in handling incoming enquiries. Further provider information: Data protection at IONOS.
Protection of forms by hCaptcha
Shopify uses hCaptcha by Intuition Machines, Inc. to protect forms against automated abuse. Technical information about the device, browser, network connection and interaction with the security check is processed. The check may load when a form is completed or submitted. Its purpose is to prevent spam and automated attacks. The legal basis is Article 6(1)(f) GDPR; § 25(2) TDDDG applies to strictly necessary access to the device. Where access is not strictly necessary, consent under § 25(1) TDDDG is required. Further information, including processing in the USA, is available in the hCaptcha privacy policy.
Relationship with Shopify
The Services are hosted by Shopify, which collects and processes personal data about your access to and use of the Services to provide and improve them. Data you submit to the Services is disclosed to Shopify and to third parties that may be located in countries other than your country of residence, to provide and improve the Services for you. To protect, grow and improve our business, we also use certain enhanced Shopify features that incorporate data and information from your interactions with our shop, other merchants and Shopify. To provide these enhanced features, Shopify may use personal data collected through your interactions with our shop, other merchants and Shopify. In these circumstances, Shopify is responsible for processing your personal data, including responding to your requests to exercise your rights concerning the use of your personal data for these purposes. For more information about how Shopify uses your personal data and your rights, see the Shopify consumer privacy policy. Depending on where you live, you can exercise certain rights regarding your personal data listed here through the Shopify privacy portal.
Third-party websites and links
The Services may provide links to websites or other online platforms operated by third parties. If you follow links to websites that are not affiliate websites or are not controlled by us, you should review their privacy and security policies and other terms and conditions. We do not warrant and are not responsible for the privacy or security of such websites, including the accuracy, completeness or reliability of information on them. Information you provide in public or semi-public places, including information shared on third-party social networking platforms, may also be viewed by other users of the Services and/or users of those third-party platforms, without restrictions on its use by us or a third party. Our inclusion of such links does not mean that we endorse the contents of those platforms or their owners or operators, unless expressly stated in the Services.
Children’s data
The Services are not intended for use by children, and we do not knowingly collect personal data from children who have not reached the age of majority in your country. If you are the parent or guardian of a child who has provided personal data to us, you may contact us using the details below to request deletion of that data. At the time this privacy policy takes effect, we have no knowledge of “sharing” or “selling” personal data of persons under 16 years of age, as those terms are defined in applicable law.
Security and retention of your data
Please note that no security measures are perfect or impenetrable and we therefore cannot guarantee “perfect security”. Information you send to us may also be exposed to risks during transmission. We recommend that you do not use insecure channels to send us sensitive or confidential information.
How long we retain your personal data depends on various factors, such as whether we need the data to manage your account, provide Services, comply with legal obligations, resolve disputes or enforce other applicable agreements and policies.
Your rights and choices
Depending on where you live, you may have some or all of the rights listed below regarding your personal data. These rights are not absolute, however, may apply only in certain circumstances, and in some cases we may refuse your request as permitted by law.
- Right of access. You may have the right to request access to the personal data we hold about you.
- Right to erasure. You may have the right to request that we erase the personal data we hold about you.
- Right to rectification. You may have the right to request that we correct inaccurate personal data we hold about you.
- Right to data portability. You may have the right to receive a copy of the personal data we hold about you and request that we transfer it to a third party in certain circumstances and subject to certain exceptions.
- Managing communication preferences. We may send you promotional emails. You may opt out at any time by using the unsubscribe option included in our emails. If you opt out, we may still send non-promotional emails, for example about your account or orders you have placed.
If you live in the United Kingdom or the European Economic Area, subject to exceptions and limitations under local law, you may exercise the following rights in addition to those above:
- Right to object and right to restriction of processing. You may have the right to request that we stop or restrict processing personal data for certain purposes.
- Withdrawal of consent. Where we rely on consent to process your personal data, you have the right to withdraw that consent. Withdrawal does not affect the lawfulness of processing based on consent before its withdrawal.
You may exercise these rights where indicated in the Services or by contacting us using the details below. More information about how Shopify uses your personal data and your rights, including rights concerning data processed by Shopify, is available at https://privacy.shopify.com/en.
You will not be disadvantaged for exercising these rights. Where permitted or required by applicable law, we may need to verify your identity before processing your requests. In accordance with applicable laws, you may designate an authorised agent to submit requests to exercise your rights on your behalf. Before accepting such a request from an agent, we require proof that you authorised the agent to act on your behalf. You may need to confirm your identity directly with us. We will respond to your request promptly in accordance with applicable law.
Complaints
If you have complaints about how we process your personal data, please contact us using the details below. Depending on where you live, you have the right to appeal our decision by contacting us using those details or lodge your complaint with the competent data protection authority. A list of competent data protection supervisory authorities is available for the European Economic Area. You may access that list here.
International transfers
Please note that we may transfer, store and process your personal data outside your country of residence.
When we transfer your personal data outside the European Economic Area or the United Kingdom, we rely on recognised transfer mechanisms such as the European Commission’s standard contractual clauses or equivalent agreements issued by the competent United Kingdom authority, unless the transfer is to a country recognised as providing an adequate level of protection.
Changes to this privacy policy
We may update this privacy policy from time to time, for example to reflect changes to our practices or for other operational, legal or regulatory reasons. We will publish the revised policy on this website, update the “Last updated” date accordingly and provide any notice required by applicable law.
