General terms and conditions

Scope

These general terms and conditions apply to all orders placed by consumers through the Aparu Essence online shop.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity.

Contracting party and formation of the contract

The presentation of products in the online shop is not a legally binding offer, but a non-binding invitation to place an order. By clicking the button to complete the ordering process, you submit a binding offer to purchase the goods in your cart.

The offer is accepted by an order confirmation sent by email or by dispatch of the goods.

Prices and shipping costs

The displayed selling prices include statutory VAT. The applicable currency is shown with the price and at checkout.

Shipping costs may apply in addition to the stated prices unless free shipping is offered. You can find the shipping costs in our shipping information and during the ordering process before submitting your order.

Delivery

Delivery is made to the delivery address provided by the customer.

Information about delivery times is provided in the respective product description or shipping information. Unless otherwise stated there, the delivery times specified in the shop apply.

Payment

The payment methods shown during the ordering process are available in the online shop.

When payment is due and charged depends on the selected payment method and the information at checkout. For payment methods that fall due immediately, payment may be charged when the pre-order is placed, before the goods are dispatched.

Retention of title

The goods remain the property of Aparu Essence until paid for in full.

Right of withdrawal

Consumers have a right of withdrawal. Details are set out in the separate withdrawal instructions in the Aparu Essence online shop.

Statutory guarantee

Statutory guarantee rights apply.

Liability

Claims for damages are governed by the statutory provisions.

Consumer dispute resolution

Aparu Essence is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.

Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law must not deprive them of the protection of mandatory provisions of the law of the country of their habitual residence where those provisions would apply in the absence of that choice of law.

If individual provisions of these terms are wholly or partially invalid, the validity of the remaining provisions is unaffected.
